Welcome to Custom Checkout Extensions, a Shopify app that allows you to customize your checkout page. By using Custom Checkout Extensions, you agree to be bound by these terms and conditions ("Terms").

1. Introduction

These Terms govern your access to and use of Checkout Extensions, a Shopify app developed and operated by Marcus Web Solutions.

2. Definitions

• App: The Custom Checkout Extensions Shopify app.

• Content: Any information, data, text, software, code, scripts, graphics, photos, sounds, music, videos, information, or other materials displayed, used, or provided in connection with the App.

• Merchant: Any individual or entity that uses the App.

• Shop: The Shopify store owned and operated by the Merchant.

• We: Marcus Web Solutions, the developer and operator of the App.

3. Services

The App provides Merchants with the ability to customize their checkout page on Shopify. The App allows Merchants to:

• Change the look and feel of the checkout page

• Add new features and functionality to the checkout page

• Collect additional information from customers at checkout

4. Fees and Payment

The App offers a free plan and paid plans. The features available and the price of the paid plans are available on the App's pricing page.

5. Term and Termination

These Terms will remain in full force and effect while you use the App. You may terminate your use of the App at any time.

6. Warranties and Disclaimers

The App is provided "as is" and without warranty of any kind, express or implied. We disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

We will not be liable for any damages arising out of or related to your use of the App, including, but not limited to, direct, indirect, consequential, incidental, or punitive damages.

8. Intellectual Property

We own all intellectual property rights in the App, including the Content. You may not use the App's name, logo, or other trademarks without our prior written permission.

9. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of California without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in the English language and will be held in the city of San Diego, CA. The decision of the arbitrator will be final and binding on both parties.

10. Entire Agreement

These Terms constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.

12. Amendments

We may amend these Terms at any time by posting the amended Terms on the App. Your continued use of the App after the posting of the amended Terms constitutes your acceptance of the amended Terms.

13. Merchant Settings

The Merchant is responsible for the accuracy and completeness of all settings entered into the App. We are not responsible for any loss or damage caused by the deletion or modification of Merchant settings. The Merchant is responsible for regularly backing up their settings.

14. Indemnification

The Merchant agrees to indemnify and hold harmless us, our officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or relating to the Merchant's use of the App.
